Welcome to NJ Construction Projects. These Terms of Service ("Terms") govern your use of our website and the construction services we provide in Perth, Western Australia.

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

3. Construction Services

3.1 Quotations

All quotations provided are:

  • Valid for 30 days from the date of issue unless otherwise stated
  • Subject to site inspection and verification of information provided
  • Based on the scope of work described and may be adjusted if requirements change
  • Exclusive of GST unless otherwise stated

3.2 Contracts

Construction services will be provided under a formal written contract that includes:

  • Detailed scope of work
  • Project timeline and milestones
  • Payment terms and schedule
  • Warranties and guarantees
  • Variation procedures
  • Dispute resolution process

All contracts will comply with the Building Services (Registration) Act 2011 (WA) and other applicable Western Australian construction legislation.

3.3 Payment Terms

Unless otherwise agreed in writing:

  • Payment schedules will be agreed upon in the construction contract
  • Progress payments are due within 7 days of invoice
  • Late payments may incur interest charges as permitted by law
  • We reserve the right to suspend work if payments are not received as agreed

3.4 Variations

Any changes to the agreed scope of work must be documented in writing and signed by both parties. Variations may affect the project timeline and cost. We will provide a written variation quote before proceeding with any changes.

4. Project Management Services

Our FREE project management service includes:

  • Single point of contact throughout the project
  • Coordination of trades and suppliers
  • Regular progress updates
  • Quality control and site supervision
  • Documentation and project records

This service is included at no additional cost for all construction projects contracted with NJ Construction Projects.

5. Warranties and Guarantees

5.1 Workmanship Warranty

We warrant that all work will be performed in a professional and workmanlike manner, in accordance with industry standards and applicable building codes.

5.2 Statutory Warranties

In accordance with Western Australian law, we provide statutory warranties as required under the Building Services (Registration) Act 2011 (WA), including:

  • Work will be carried out in a proper and workmanlike manner
  • Materials used will be good and suitable for their purpose
  • Work will comply with all applicable laws and regulations
  • Work will be completed with reasonable care and skill

5.3 Defects Liability

Defects arising from faulty workmanship or materials will be rectified at no cost during the defects liability period specified in your construction contract (typically 12 months from practical completion).

6. Limitations of Liability

To the maximum extent permitted by law:

  • We are not liable for delays caused by circumstances beyond our reasonable control (weather, supplier delays, client-caused delays, unforeseen site conditions)
  • Our liability is limited to the contract value of the specific project
  • We are not liable for indirect or consequential losses
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence

7. Insurance

We maintain appropriate insurance coverage including public liability insurance and workers' compensation insurance as required by Western Australian law. Proof of insurance can be provided upon request.

8. Dispute Resolution

In the event of a dispute:

  1. We will first attempt to resolve the matter through direct negotiation
  2. If negotiation fails, we may engage in mediation
  3. Disputes may be referred to Building Commission WA if appropriate
  4. As a last resort, disputes will be resolved through the courts of Western Australia

9. Health and Safety

We are committed to maintaining a safe work environment and comply with all Western Australian occupational health and safety legislation. All personnel on our construction sites must:

  • Wear appropriate personal protective equipment
  • Follow site safety procedures and signage
  • Report any hazards or incidents immediately
  • Not access construction sites without authorization

10. Environmental Compliance

We comply with all applicable environmental laws and regulations, including proper waste disposal, noise control, and dust management. We strive to minimize environmental impact on all our construction projects.

11. Termination

Either party may terminate a construction contract in accordance with the termination provisions specified in the contract. Termination rights and procedures will comply with applicable Western Australian legislation.

Upon termination, payment is due for all work completed to the date of termination, including reasonable costs incurred.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy, which complies with the Australian Privacy Principles.

13. Governing Law

These Terms are governed by the laws of Western Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Continued use of our website after changes constitutes acceptance of the updated Terms. Construction contracts remain subject to the terms agreed at the time of signing.
